Upon information filed by the county attorney of Ramsey county, defendant was charged with the crime of indecent exposure. Subsequently, the court granted his motion to amend the information so as to state that his prior conviction therefor in the municipal court of Minneapolis for a similar offense was for a violation of a municipal ordinance and not for violation of a state statute. Upon his arraignment on the amended information, he pleaded guilty thereto, and the court, Gustavus Loevinger, Judge, found defendant guilty of a gross misdemeanor and certified to this court the question whether the offense charged in the amended information was a gross or a simple misdemeanor.
